1. Nature of Services
SmishGuard provides professional open-source intelligence (OSINT) investigation, threat monitoring, and intelligence reporting services. Our services are for intelligence and documentation purposes only. We are not a law firm, a law enforcement agency, a licensed private investigations firm in jurisdictions requiring licensure for the specific activities performed, or a mental health provider, and nothing in our deliverables constitutes legal, medical, or psychological advice.
2. No Guarantees
Results are not guaranteed due to the unique nature of each case. SmishGuard does not promise, imply, or guarantee: (a) the deletion or removal of any content from any platform; (b) identification of any threat actor; (c) any particular outcome in any legal, civil, or criminal proceeding; or (d) cessation of threats. Any company promising guaranteed content deletion in sextortion cases is misrepresenting what is technically and legally possible.
3. Lawful Conduct
We do not engage in hacking, unauthorized access, or any activity that violates federal or state law, including the Computer Fraud and Abuse Act (CFAA) and the Electronic Communications Privacy Act (ECPA). All investigations are conducted exclusively through open-source and authorized channels. Requests that we engage in unlawful conduct will be declined and, where required by law, reported.
4. Eligibility & Client Obligations
Clients must provide truthful, accurate information and may only engage our services for lawful purposes, including documenting threats against themselves or minors under their guardianship. We reserve the right to decline or terminate any engagement, with proportional refund, if we determine the services are being sought for harassment, stalking, retaliation, or any unlawful purpose.
5. Engagements & Payment
Each engagement is defined by a written agreement specifying deliverables, monitoring window, report specifications, and cost. Tiers are fixed-price: Essential ($700 / 5 days), Advanced ($1,800 / 15 days), Professional ($2,900 / 30 days). There are no hidden fees and no mid-engagement price increases. Active monitoring begins within 24 hours of a signed agreement.
6. Cancellation & Refunds
Clients may cancel in writing within 48 hours of signing for a full refund minus work already performed. After work commences, refunds are prorated against deliverables completed. Engagement windows are continuous; pausing a monitoring window requires written agreement.
7. Confidentiality
Client information is held in strict confidence and is never shared, sold, or disclosed except: (a) with the client's express written instruction; or (b) where required by valid legal process. We do not use client matters for marketing, testimonials, or case studies without explicit written consent.
8. Intellectual Property
Upon full payment, clients receive a perpetual, non-exclusive license to use the delivered intelligence report for their personal, legal, and law-enforcement reporting purposes. SmishGuard retains all rights to its methodologies, templates, and underlying work product.
9. Limitation of Liability
To the maximum extent permitted by law, SmishGuard's aggregate liability under any engagement is limited to the fees paid for that engagement. We are not liable for indirect, consequential, or punitive damages, or for actions taken by third parties.
10. Severability & Governing Law
If any provision is held unenforceable, the remainder stays in force. These terms are governed by the laws of the state of SmishGuard's principal place of business, without regard to conflict-of-law rules. Venue for any dispute shall be that state's courts.
11. Changes
We may update these terms; the version in effect at the time an engagement agreement is signed governs that engagement.
